SC halts mosque survey orders, restricts lower courts in pending cases
A CBI court has denied bail to Sandip Ghosh, the former principal of RG Kar Medical College and Hospital, in the horrific rape and murder case of a postgraduate trainee doctor. The court highlighted the grave nature of the charges against Ghosh, noting that if proven, they could result in a death penalty, reserved for the rarest of rare cases. Ghosh, along with former Tala police station officer-in-charge Abhijit Mondal, was arrested on August 9 by the CBI for allegedly tampering with evidence and delaying the FIR in the case.
On September 25, Additional Chief Judicial Magistrate S Dey extended the CBI custody of Ghosh and Mondal until September 30, stating that releasing them on bail would be an injustice and a violation of equity principles. The judge emphasized that a crime can be committed with the help of others, even without their presence at the crime scene.
Ghosh’s lawyer argued during the Sealdah Court hearing that he was falsely implicated and had no role in the crime. However, the court sided with the CBI, which alleged that Ghosh and Mondal were involved in fabricating records at Tala Police Station to cover up the crime. The CBI also revealed that custodial interrogation had uncovered additional forged documents and manipulated evidence, further complicating the case against them.
